These General Terms and Conditions govern the use of the platform operated by DomiVenDomo Tech FZ-LLC at domivendomo.com. The German version is the authoritative contractual language. Last updated: 18 October 2026.
Section 1 Scope
(1) These Terms apply to all contracts between DomiVenDomo Tech FZ-LLC, CWEP6265, Compass Building, Al Shohada Road, Al Hamra Industrial Zone-FZ, Ras Al Khaimah, UAE (the “platform” or the “provider”) and natural or legal persons who use the platform, whether as a lister (seller, host, service provider) or as a seeker (buyer, guest, booker).
(2) Differing, conflicting or supplementary general terms and conditions of the user do not become part of the contract unless their application is expressly agreed in writing.
(3) Where the user is a consumer within the meaning of Section 13 of the German Civil Code (BGB), the mandatory provisions of European Union consumer protection law apply in addition.
Section 2 Conclusion of contract
(1) By registering a user account on the platform, a framework agreement for the use of the platform's basic functions is concluded between the user and the provider, free of charge.
(2) Registration requires that you have reached the age of 18 and have full legal capacity. Legal persons are represented by their legal representatives.
(3) The user is obliged to provide truthful and complete information when registering.
(4) The provider reserves the right to refuse a registration without giving reasons.
Section 3 Platform services
(1) The provider makes available a marketplace infrastructure through which listers can post listings in the categories Buy, Rent, Stay, Dining, Services and Experiences, and seekers can get in touch with them.
(2) The provider does not become a party to the contracts concluded between listers and seekers via the platform. It acts solely as an intermediary.
(3) The functions include in particular: AI Property Twin (AI-assisted listing support), Virtual Tour and What's Nearby. Which functions are available in detail follows from the current version of the platform.
(4) The provider is entitled to change, add to or discontinue individual functions, provided this is reasonable for the user and does not materially impair the purpose of the contract.
Section 4 User obligations
(1) The user undertakes to use the platform exclusively for lawful purposes and to comply with applicable law, in particular the law of the Federal Republic of Germany and of the European Union.
(2) The following are prohibited in particular: posting untrue, misleading or unlawful listings; registering using false or another person's details; posting content that infringes third-party protected rights; attempting to manipulate reviews, reach or search results; using automated procedures to extract data from the platform (scraping); any attempt to circumvent or compromise the security of the platform.
(3) In the event of repeated or serious breaches, the provider is entitled to suspend the user account temporarily or to close it permanently.
(4) By posting content (in particular photos, videos, texts and other works protected by copyright), the user grants the provider a simple right of use, limited in territory and in subject matter to the operation of the platform, to reproduce that content, make it publicly available and edit it to the usual extent (for example cropping, compression), to the extent that this serves to present the respective listing on the platform, in the app search and on the associated category and overview pages. The right of use ends when the respective listing or item of content is deleted, unless technical reasons (for example caching, backups) require a short-term continuing effect. The user warrants that they are entitled to grant these rights and that the content posted does not infringe the rights of third parties (in particular copyright, trade mark and personality rights); the user indemnifies the provider against all third-party claims based on a culpable breach of this warranty by the user, including the reimbursement of reasonable costs of legal defence. The user remains free to demonstrate that no breach of duty has occurred.
Section 5 Listings & fees
(1) Posting listings is free of charge at present. We will introduce a fee only by amending these Terms under Section 10, and we will inform you before we do. We do not charge any commission on bookings or sales.
(2) If we introduce a fee, its amount will depend on the category and the duration of the listing and will be shown in your account dashboard. The prices shown there are binding; unless stated otherwise, they are in euros. All prices stated are final prices and include VAT where it applies.
(3) In that case, billing will be handled by the payment service provider Stripe Payments Europe, Ltd. Extraordinary termination results in a pro-rata refund of fees already paid.
(4) The lister is obliged to keep their listing up to date and to represent availability, price and description truthfully.
Section 6 Bookings & payments
(1) Bookings are concluded directly between the seeker and the lister. The provider merely provides the intermediation and the communication for this; the provider does not process payments and does not act as an escrow.
(2) At present, no payments between seeker and lister are accepted or forwarded via the platform. The parties agree the means and route of payment directly with each other.
(3) The provider does not make any payouts to listers. Payment between seeker and lister is settled outside the platform; the provider is not involved in it and does not owe any payout deadline.
(4) Cancellation and refunds are governed by the agreement between seeker and lister. As the provider is not involved in the payment, it does not make any refunds.
Section 7 Reviews
(1) Reviews may be submitted only by users who have actually booked the listing or used the service.
(2) A review is given as an overall rating of one to five stars. In addition, partial ratings may be given: match with the listing, communication and value for money; for accommodation, also cleanliness and location.
(3) Reviews are published without their content being checked beforehand. If a review violates these Terms, we remove it once we become aware of it.
(4) A published review is deleted only in the following cases: (a) by court order; (b) in the case of a demonstrably false statement of fact; (c) in the case of an infringement of personality rights. The lister may publicly respond to any review.
(5) A review does not appear immediately. It stays hidden until the other party has also submitted a review of the same booking; both then become visible at the same time. If the other party does not submit a review, yours appears 14 days after you submit it. If we have removed a review under paragraph 3 or 4, it does not appear after those 14 days either. Each party may submit one review per booking.
Section 8 Liability
(1) The provider is liable without limitation for damage arising from injury to life, body or health based on an intentional or negligent breach of duty by the provider, and for other damage based on an intentional or grossly negligent breach of duty.
(2) In the event of a breach of essential contractual obligations (cardinal obligations) through simple negligence, the provider's liability is limited to the damage typically foreseeable under this type of contract.
(3) Any further liability is excluded. In particular, the provider is not liable for content posted by listers or seekers, nor for the performance of the contracts concluded between listers and seekers.
(4) The provisions of Section 309 of the German Civil Code (BGB) remain unaffected. The limitation of liability does not apply to claims under the German Product Liability Act.
Section 9 Termination
(1) The user may close their user account at any time, without notice period, using the corresponding function in the dashboard. Listing fees already paid are refunded on a pro-rata basis.
(2) The provider may terminate the framework agreement with 30 days' notice to the end of the month. The right to extraordinary termination for cause remains unaffected.
(3) After the contract ends, the user may request a copy of the data we hold about them; we provide it in a common, machine-readable format. On request, we then delete the data, unless statutory retention obligations prevent this; what applies to logs and backup copies is set out in the privacy policy.
(4) Accounting records are archived for ten years in accordance with Section 147 of the German Fiscal Code (AO) and Section 257 of the German Commercial Code (HGB).
Section 10 Changes to the Terms
(1) The provider reserves the right to adjust these Terms where this is necessary because of a change in the legal situation, technical developments or an extension of the range of services, and where it does not unreasonably disadvantage the user.
(2) The user is informed of changes at least 30 days before they take effect, by email to the address held in the account and by a notice in the dashboard.
(3) If the user does not object to the change within that period, the amended terms are deemed to have been accepted. The notice draws separate attention to the right to object and to the consequences of remaining silent.
(4) If the user objects in time, the provider is entitled to terminate the contract with effect from the date on which the change takes effect.
Section 11 Governing law & place of jurisdiction
(1) The legal relationship between the provider and the user is governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the state in which the user has their habitual residence remain unaffected.
(2) The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Berlin, to the extent that the user is a merchant, a legal person under public law or a special fund under public law, or has no general place of jurisdiction in the Federal Republic of Germany.
(3) The provider is not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration body.
Section 12 Final provisions
(1) Should individual provisions of these Terms be or become invalid or unenforceable, or become invalid or unenforceable after the contract is concluded, this does not affect the validity of the remainder of the contract. The invalid or unenforceable provision is to be replaced by the valid and enforceable provision whose effects come closest to the economic purpose which the parties pursued with the invalid provision (severability clause).
(2) Amendments and additions to these Terms must be made in text form (email is sufficient). The text form requirement may be waived only by express agreement.
(3) These Terms are authoritative in their German version. Translations into other languages serve only to aid understanding.
